The CNF is going to approve the Regulation on Associations entrusted to the lawyer to release the status of "specialist".
The CNF has prepared the draft regulation [1] governing the establishment of the bar associations of specialization in the reform of 2012. The latter, as is well known, also introduced for lawyers, like other professionals, the opportunity to specialize in certain areas and thus obtain the title of "specialist" [2]. The way in which that title has been delegated to ad hoc regulation that, in fact, is about to be enacted.
The draft Regulation provides a list of the associations authorized to issue the diploma of specialization and in charge of the CNF support in the organization of courses and schools for lawyers.
The bar associations at candidate list must meet the following requirements:
1) the provision in the statute of the purpose, even if not exclusively, to promote profiles for specialized, training and updating in the matter of competence;
2) a significant number of members on a national basis, taking into account the area of ??interest;
3) the presence of a place of business in at least half of the districts of the Court of Appeal;
4) a place and a national body that coordinates the activities of offices located throughout the national territory;
5) internal organization on a democratic basis;
6) an education in the areas of expertise through organizational structures and technical-scientific adequate;
7) the absence of profit and gratuity training activities, notwithstanding the possibility to request participants to the reimbursement of expenses incurred in the organization.
The forensic specialist associations wishing to secure the inclusion in the list must:
a) send the application by registered mail with return receipt to the administrative headquarters of the CNF or by certified mail;
b) attach to the application documentation proving they meet the requirements listed above.
The list of associations will be posted on the website of the CNF and will be constantly updated.
The final approval of the regulation is expected next April 10.
